Welcome to BMDRM. These Terms of Service ("Terms") govern your access to and use of the BMDRM website, applications, dashboards, APIs, players, and related services (collectively, the "Service"). By creating an account, uploading content, or otherwise using the Service, you agree to be bound by these Terms.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

1. The Service

BMDRM provides secure video hosting, DRM-protected streaming, content encryption, and analytics tools that help creators, educators, and businesses protect and deliver their video content. Features, limits, and availability may change as we improve the Service.

2. Your Account

To use most parts of the Service you need an account. You agree to:

• provide accurate and current registration information,
• keep your credentials and API keys confidential,
• be solely responsible for all activity that occurs under your account, and
• notify us promptly at [email protected] of any suspected unauthorized access.

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service.

3. Your Content

You retain all ownership of the videos, images, captions, metadata, and other materials you upload ("Your Content"). You grant BMDRM a worldwide, non-exclusive, royalty-free license to host, store, transcode, encrypt, package, cache, and deliver Your Content for the sole purpose of operating and providing the Service to you and your viewers.

You are responsible for Your Content and confirm that you have all rights necessary to upload it and that it does not infringe on any third-party rights or violate any applicable law.

4. Acceptable Use

You agree not to use the Service to:

• upload, store, or stream content that is illegal, infringing, defamatory, or that exploits minors;
• circumvent the DRM, watermarking, or access controls of any content (including your own once protected);
• attempt to gain unauthorized access to the Service, other users' accounts, or our infrastructure;
• run automated scraping, denial-of-service, or load testing without prior written consent;
• resell or sublicense the Service to third parties outside the scope of your subscription.

We may suspend or terminate accounts that violate these rules, with or without notice when required to protect the Service or its users.

5. Plans, Billing, and Refunds

Paid plans, usage tiers, and add-ons are described on our Pricing page. Subscriptions renew automatically until canceled. Fees are non-refundable except where required by law or explicitly stated in a written agreement. Taxes are your responsibility unless we are required to collect them on your behalf.

6. Intellectual Property

The Service, including its software, design, trademarks, and documentation, is owned by BMDRM or its licensors and is protected by intellectual property laws. These Terms grant you a limited, revocable, non-transferable right to use the Service; they do not transfer any ownership.

7. Third-Party Services

The Service may integrate with third-party providers (e.g., DRM license servers, CDNs, payment processors, analytics). Your use of those services is subject to their own terms and we are not responsible for them.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, BMDRM will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD 100.

10. Termination

You can stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or use the Service in a way that creates risk for us or other users. On termination, your right to use the Service ends and we may delete Your Content after a reasonable retention window.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you (for example, by email or an in-product notice) before they take effect. Your continued use of the Service after changes become effective constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which BMDRM is established, without regard to its conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory consumer-protection laws of your country of residence apply.
